Terms of Use for Website

 

1. Access to the Platform is permitted on a temporary basis and TravelLocal reserves the right to withdraw or amend the service provided on the Platform without notice. TravelLocal shall not be liable if for any reason the Platform is not available at any time or for any period. From time to time, TravelLocal may restrict access to some parts of the Platform, or the entire Platform, if required. TravelLocal aims to update the Platform regularly and may change the content at any time. TravelLocal may therefore have to suspend access to the Platform, or close it if necessary. Any of the material (including pricing and details of travel arrangements) on the Platform may be out of date or incorrect at any given time and TravelLocal is under no obligation to update such material, however will use all reasonable endeavours to correct errors or omissions as quickly as practicable after being notified of them.

 

2. If you choose, or you are provided with, a user identification code/name, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any provision of these Terms of Use.

 

3. Commentary and other materials posted on the Platform are done so using all reasonable skill and care; however, they are based on our opinion and are not intended to and do not amount to advice. TravelLocal disclaims all liability and responsibility arising from any reliance placed on such materials by any visitor to the Platform, or by anyone who may be informed of any of its contents. We may from time to time provide interactive services on the Platform, including bulletin boards and chat rooms (please see further below). Where we do provide any interactive services, we will provide clear information to you about the kind of service offered, if it is moderated and how, and will use reasonable endeavours to assess any possible risks for users when using the interactive service. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on the Platform and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards set out in these Terms of Use. Any contributions made to our interactive service must be accurate and genuine and comply with all applicable laws and regulations and our Terms of Use detailed herein.

 

4. You are responsible for making all arrangements necessary for you to have access to the Platform and for ensuring that all persons who access the Platform through your internet connection are aware of these terms and that they comply with them.

 

5. Information about potential travel arrangements that you might book through the Platform has been either put together by Travellocal (for information purposes), or we are presenting information that has been provided / verified by a third party (including Local Tour Operators).  The Local Tour Operators that we feature on the Platform provide details of pricing, descriptions of travel arrangements, etc, as well as confirming details relating to a particular itinerary that you might be interested in.  We will provide all information presented by Local Tour Operator to you, but we are not responsible for any errors, omissions or other inaccuracies in information directly provided to you by Local Tour Operators. Liability to you in connection with any bookings and cancellations made through the Platform are set out in our Booking Terms and Conditions and the relevant Local Tour Operator’s Terms and Conditions for the supply of arrangements to you.

 

6. All tours, trips and travel arrangements shown on the Platform are subject to availability and you must always check with the relevant Local Tour Operator to see whether tours, trips or travel arrangements are available prior to booking. You may book tours, trips or other travel services with a Local Tour Operator through the Platform.

 

7. Any links provided on the Platform to other Platforms are not intended to provide an endorsement by TravelLocal and TravelLocal will have no liability or responsibility for the content of this or those Platforms whatsoever. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage if it, but you must not establish a link to this Platform in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any Platform which is not owned by you. Our Platform must not be framed on any other Platform, nor may you create a link to any part of our Platform other than the homepage. We reserve the right to withdraw linking permission without notice. The Platform from which you are linking must comply in all respects with the content standards set out above.

 

8. Whenever you use a feature of the Platform that allows you to upload material to the Platform, or make contact with others through the Platform, you must comply with the following content standards, in particular you must ensure:
   
   8.1. you do not use the Platform in a way that breaches any applicable local, national or international law or regulation, or in a way that is unlawful or fraudulent, or has an unlawful or fraudulent purpose or effect;
   
   8.2. the Platform is not used for the purpose of harming or attempting to harm others (particularly minors) in any way;
   
   8.3. you must not use the Platform to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards;
   
   8.4. there is no access obtained (without our authority), and no interference with, damage or disruption to any part of the Platform, any equipment or network on which our Platform is stored, any software used in the provision of the Platform or any equipment or network or software owned or used by any third party; and
   
   8.5. you do not use the Platform to gain a commercial advantage to the detriment of TravelLocal.
   
   You warrant that any contribution made and/or material uploaded complies with these standards and you agree to indemnify us for any breach of that warranty.

 

9. TravelLocal cannot guarantee that the Platform is free from infection by viruses or anything else that has contaminating or destructive properties. You must not misuse the Platform by introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Platform, the server on which the Platform is stored or any server, computer or database connected to the Platform.

 

10. Any destination/attraction/tour/travel guide information on this Platform written or provided by TravelLocal is purely for information. TravelLocal endeavours to ensure that such information is accurate and requests that such information from Local Tour Operators is accurate, however TravelLocal provides no guarantee that such information is accurate. This information does not form part of your agreement with any third party (including Local Tour Operators) and is provided solely as additional background content. TravelLocal shall not be held liable in any way whatsoever for any inaccuracy, misunderstanding or expectation drawn from this content.

 

11. All rights in the Platform, including copyright, the content and design of the Platform, is owned by TravelLocal or used under licence from third party owners. Any use of this Platform or its contents, including copyright or storing it or them in whole or part, other than for your personal or non-commercial use is prohibited without the written permission of TravelLocal. You are prohibited from copying, modifying, transmitting, distributing, selling, displaying, licensing or reproducing any content including images and other media on this Platform for any commercial purpose. You must also not change the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. If you print off, copy or download any part of the Platform in breach of these Terms of Use, your right to use the Platform will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

 

12. If you breach the provisions of these Terms of Use, TravelLocal shall be entitled to suspend or permanently terminate your access to the Platform and where appropriate seek remedy in law and courts.

 

13. To the maximum extent permitted by law, TravelLocal disclaims all liability, representations, warranties, whether express or implied by statute, custom or usage relating to the information contained in or services offered on this Platform. This does not affect your statutory rights under English law. TravelLocal shall not be liable for any losses or damages (whether direct, indirect or consequential) whatsoever, whether in contract, tort (including negligence), or otherwise arising from this Platform, or from any interruption or delay in accessing this Platform.

 

14. As a community based Platform, TravelLocal encourages registered users to interact on the Platform, including forums, blogs, images, reviews and any other interactive functionality that is developed in the future. You agree to use these functions to post, review and receive information and material that are proper and related to the travel topic on the Platform. You also agree and undertake that you will not use the Platform in an inappropriate manner (as judged by TravelLocal in its absolute discretion), including (but not limited to):
    
    14.1. use foul or abusive language or behaviour or otherwise violate the legal rights of others;
    
    14.2. post, upload or distribute any indecent, obscene, defamatory or unlawful material or information - the transmission of unlawful, threatening, pornographic, political or racist material is strictly prohibited;
    
    14.3. advertise or offer to sell any goods or services, conduct surveys, promotions or links to other Platforms;
    
    14.4. post images or content that is protected by copyright or other intellectual property rights, unless you own or control the rights or have gained the necessary consents;
    
    14.5. delete or falsify the origin or source of images or content uploaded; or
    
    14.6. post files that contain viruses or any similar software that may cause damage to the Platform or to an individual user’s computer.

 

15. By using any community forums, including commenting on a blog post or submitting a trip review on the Platform you are consenting to the publication of your contribution accessible by all users of the Platform. Any material you upload to the Platform will be considered to be non-confidential and non-proprietary and TravelLocal has the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our Platform constitutes a violation of their intellectual property rights, or of their right to privacy. You acknowledge that forums, postings, blogs, reviews and other communications shall not be considered, reviewed, screened or approved by TravelLocal and we will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the Platform. We have the right to remove any material or posting you make on our Platform if, in our opinion, such material does not comply with the content standards set out in these Terms of Use.

 

Privacy Policy

TravelLocal processes information about you in accordance with the Privacy Policy displayed on the Platform from time to time. By using the Platform you consent to such processing and you warrant that all data provided by you is accurate.
